To file for divorce in New York, either you or your spouse must meet the residency requirements. At least one of you must have been living in New York for a continuous period of two years immediately before the start of the divorce case. There are exceptions to this rule, such as if you got married in New York or if both spouses are residents of New York at the time of filing.
